A number of state governments across the United States began issuing social distancing guidelines to citizens to reduce the COVID-19 infection rate. As cases continued to rise, some states issued stay-at-home orders, advising people to only leave their homes to purchase essentials such as groceries. Mandates were later issued banning indoor public gatherings and other group-oriented activities. Many businesses where people typically gathered indoors, such as bars and hair salons, were ordered to close, leaving millions of workers unemployed. The pandemic began to take an economic toll on the country as spending decreased, unemployment increased, and businesses struggled to stay afloat.

This meant that very few prisoners with care and support needs were having these needs properly assessed or met in an effective way. The Children and Families Act creates a new ‘birth-to-25 years’ Education, Health and Coronavirus Aid, Relief, and Economic Security (CARES) Act Care Plan (EHC) for children and young people with special educational needs , and offers families personal budgets so that they have more control over the type of support they get. In some cases, where a person is over 18, the ‘Care’ part of the EHC plan will be provided for by adult care and support, under the Care Act. The Act makes clear that the local authority can combine any of these ‘transition’ assessments with any other assessment being carried out for some other person (provided all parties agree).

The Act also makes new rules about working with young carers, or adult carers of disabled children, to plan an effective and timely move to adult care and support (see factsheet 3 and factsheet 11). Whilst the Act gives local authorities the power to charge for care and support, they may not charge for services which the regulations say must always be free, for example reablement services or equipment and minor adaptations to the home. First, a local authority will assess someone and decide whether they have eligible care needs.

Important to note, ESSER II funds should be reported on separate from ESSER funds. Successful completion of a CARE agreement or CARE plan conclude with graduation by the Court. The participant remains eligible for ongoing treatment, supportive services, and housing in the community to support long term recovery. After the assessment, the local authority must then determine whether the person is eligible for care and support using the same eligibility framework used for people living in the community. If they are assessed as having needs that meet the eligibility criteria, the local authority will meet those needs. The Act creates a single, consistent route to establishing an entitlement to public care and support for all adults with needs for care and support. It also creates the first ever entitlement to support for carers, on a similar basis (see also factsheet 8).The Act is also clear about the steps that must be followed to work out this entitlement, to help people understand the process. It begins with an assessment of their needs and a decision about whether their needs are eligible, including a financial assessment where necessary. This will determine whether people need to pay for their own care, and in the future will include the new capped costs payment system (see factsheet 6). After this process of assessment is finished, the decision can then be made about whether the adult is entitled to care and support arranged by the local authority.
